7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Data Advisor Hub AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID TO US FOR SERVICES DIRECTLY RELATING TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY). 8. Indemnity

You will defend, indemnify, and hold harmless Data Advisor Hub and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms, except to the extent caused by our willful misconduct.

9. Governing law and venue

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules. You agree that the state and federal courts located in San Francisco County, California will have exclusive jurisdiction for disputes arising out of or relating to these Terms or the Site, subject to applicable law regarding mandatory consumer venues.

10. Changes

We may modify these Terms at any time by posting an updated version on the Site and updating the “Last updated” date. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.
